Terms of service

Student / Parent-Guardian Agreement

This agreement is entered into between Smart Safe Driving and the enrolling student and/or parent/guardian. By enrolling in driving instruction services, the student and/or guardian agrees to the following terms and conditions.

1. Student Eligibility

All students participating in behind-the-wheel instruction must: 

.Possess a valid learner’s permit or driver’s license

.Carry their permit or license during every driving lesson

.Be physically and mentally capable of operating a motor vehicle safely

.Follow all instructions provided by the driving instructor

.Failure to present a valid permit or license at the time of the lesson may result in lesson cancellation and applicable cancellation fees.

2. Parental / Guardian Consent (For Students Under 18)

If the student is under the age of 18, a parent or legal guardian must sign this agreement and assumes responsibility for: Student conduct Payment of services Compliance with Smart Safe Driving policies

3. Lesson Scheduling

Driving lessons are scheduled based on instructor and vehicle availability. Students are encouraged to arrive on time and prepared for each scheduled lesson. If a student arrives late, the lesson may be shortened to avoid impacting other scheduled students.

4. Cancellation Policy

Smart Safe Driving requires at least 24 hours notice for lesson cancellations or rescheduling. Behind-the-Wheel Lessons Cancellations made less than 24 hours before the scheduled lesson will incur a $80 cancellation fee.

Simulator Training: Cancellation of a simulator session or failure to appear (no-show) will result in forfeiture of the deposit paid for that session. No-Show PolicyStudents who fail to appear for a scheduled lesson without notice may be charged the applicable cancellation fee or loss of deposit.

5. Payment Policy

Payment for lesson packages must be made prior to the start of instruction unless otherwise arranged. Deposits for simulator or reserved sessions are non-refundable if the student fails to appear. Smart Safe Driving reserves the right to suspend or cancel lessons if payment obligations are not met.

6. Instructor Authority and Safety For safety reasons, the driving instructor has the full authority to:

.Terminate a lesson if the student behaves in an unsafe manner

.Refuse instruction if the student appears impaired, ill, or unable to safely operate a vehicle

.Adjust lesson routes and exercises based on traffic or safety conditions

.No refunds will be issued if a lesson is terminated due to unsafe student behavior.

7. Liability and Risk Acknowledgment

Driving instruction involves inherent risks associated with operating a motor vehicle. By signing this agreement, the student and/or parent/guardian acknowledges that: They understand the nature of driver training They agree to follow instructor directions at all times They release Smart Safe Driving and its instructors from liability to the fullest extent permitted by law for incidents occurring during training, except in cases of gross negligence.

8. Compliance with Kentucky Driving Laws

All instruction provided by Smart Safe Driving follows the guidelines established by the Kentucky driver education standards. Students are expected to comply with all state traffic laws and regulations during instruction.
